Welcome to fikty, operated by Context Educational Group, LLC ( "we", "us", the "Company" or "fikty").

 

1. Acceptance of Terms of Use.

By creating an account fikty or by applying fikty, either through a mobile device, app or mobile equipment (collectively, the "Service") you agree to force you by (i) these terms of use, Each of which is incorporated by reference into this Agreement ,. If you do not agree you must not use the Service.

We can make changes to this Agreement and the Service occasionally. You must be at least 18 years old to create an account and use the Service fikty. By creating an account and use the Service, you represent and warrant that:

1. Your account.

1. Modification and termination of service.

Fikty is always trying to improve service and make the additional functionality that is attractive and useful. This means we can add new features or product improvements from time to time as well as remove some features, and if these actions do not materially affect their rights or obligations, which cannot provide you with notice before taking them. We can even suspend the service in full, in which case we will notify you in advance unless extenuating circumstances, such as security or security circumstances do not allow us to do so.

Fikty can cancel your account at any time without notice if you consider that you have violated this Agreement. After you cancel your account, this Agreement shall terminate, except that the following provisions shall continue to apply to you and fikty: Section 5, Section 6, and Articles 13 to 20.

1. Fikty gives you rights.

Fikty grants you a personal, worldwide, non-assignable non-exclusive revocable and not transferable to third parties to access and use the service license, royalty-free, this license is for the sole purpose of allowing you to use and enjoy the benefits of service as provided by fikty and permitted by this Agreement. So remember:

• not use the Service or any content on the Service for commercial purposes without our written consent.
• not copy, modify, transmit, create derivative works from, use or reproduce in any way any material copyrighted images, trademarks, trade names, service marks, or other intellectual property, content or proprietary information access via the Service without the prior written consent of fikty.
• not express or imply that any statements you make are endorsed by fikty.
• not use any robot, bot, spider, search robot, scraper, application site search or retrieval, proxy or other manual or automatic device, method or process to access, retrieve, index, "data mine", or any way reproduce or circumvent the navigational structure or presentation of the Service or its contents.
• not use the service in any way that would interfere with, disrupt or adversely affect the Service or servers or networks connected to the Service.
• not upload viruses or other malicious code or endanger the safety of the Service in danger.
• not forge headers or otherwise manipulate identifiers to disguise the origin of any information transmitted through the Service.
• do "frames" or "mirror" any part of the Service without prior written permission of fikty.
• not use meta tags or code or other devices containing any reference to fikty or the Service (or any trademark, trade name, service mark, logo or slogan fikty) to direct any person to any other website for any purpose.
• not modify, adapt, sublicense, translate, sell, reverse engineer, decipher, decompile or disassemble any portion of the Service or cause others to do so.
• not to use or develop any third party applications that interact with the Service or Content or information from other users without our written consent.
• not use, access or publish programming interface application fikty without our written consent.
• not probe, scan or test the vulnerability of our Service or any system or network.
• not encourage or promote any activity that violates this Agreement.

The Company may investigate and take appropriate legal action available in response to illegal and / or unauthorized use of the Service, including termination of your account.

Any software we provide you can download and install updates, enhancements or other new features automatically. You can adjust these automatic downloads via the device settings.

1. Fikty rights you grant.

By creating an account, you grant fikty a worldwide, transferable, sublicensable, royalty-free right and license to host, store, use, copy, display, reproduce, adapt, modify, publish, modify and distribute information that we authorize to access Facebook or Google, and any information you post, upload, show or put at the disposal (collectively, "post") on the Service or transmit to other users (collectively, "Content"). When you contact our customer service representatives, you agree to be respectful and friendly. If we feel that your behavior towards any of our customer service representatives or other employees is at any time threatening or offensive, we reserve the right to terminate your account immediately.

In consideration for the fact that fikty lets you use the Service, you agree that we, our subsidiaries and our third party partners may place advertising on the Service. By submitting suggestions or comments to fikty regarding our service, you agree that fikty can use and share such feedback for any purpose without make up for it.

You agree that fikty can access, preserve and disclose your account information and Content if required to do so by law or in the good faith belief that such access preservation or disclosure is reasonably necessary, such as: (i) comply with legal process ; (Ii) enforce this Agreement; (Iii) respond to claims that any Content violates the rights of third parties; (Iv) respond to your requests for customer service; or (v) protect the rights, property or personal safety of the Company or any other person.

1. Community rules.

By using the Service, you agree that you will not:

• use the Service for any purpose that is unlawful or prohibited by this Agreement.
• use the Service harmful or nefarious purposes.
• use the Service to harm fikty.
• send spam, solicit money or defraud any user.
• impersonate any person or entity or publish any image of another person without their permission.
• intimidate, "besiege" intimidate, assault, harass, abuse or defame anyone.
• post any Content that violates or infringes the rights of any person, including publicity rights, privacy, copyright, trademark or other intellectual property or contract rights.
• post any Content that is hate speech, threatening, sexually explicit or pornographic; that incites violence; or contains nudity or graphic or gratuitous violence.
• post any Content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual.
• solicit passwords for any purpose, or personal identifying information for commercial or unlawful other users or disseminate personal information about another person without their permission purposes.
• use another user's account.
• create another account if we've completed your account unless you have our permission.

Fikty reserves the right to investigate and / or terminate your account without refunding purchases if you have violated this Agreement, have misused the service or you have behaved in a way that fikty deemed inappropriate or illegal, including actions or communications occurring inside or outside the Service.

1. Users' content.

Although fikty reserves the right to review and remove Content that violates this Agreement, such Content is the sole responsibility of the user who publishes and fikty can not guarantee that all Content complies with this Agreement. If you see content that violates this Service Agreement, please report within the Service or through [email protected].

 

1. Notice and Procedure for Making Claims of copyright infringement.

If you believe that your work has been copied and posted on the Service in a way that constitutes copyright infringement, provides our copyright agent the following information:

• an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
• a description of the copyrighted work that you claim has been infringed;
• a description of where the service is in the material that you claim is infringed (and such description must be reasonably sufficient to allow us to find the alleged infringing material);
• your contact information, including address, phone number and email address;
• a written statement indicas good faith belief that the disputed use is not authorized by the owner of the copyright, its agent or the law; Y
• a statement by you, made under penalty of perjury, stating that the above information in your notice is accurate and that you own the copyright and that you are authorized to act on behalf of the owner of copyright.

1. Renunciations.

Fikty PROVIDES THE SERVICE "AS IS" AND "AS AVAILABLE" AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NO WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE WITH RESPECT TO THE SERVICE (INCLUDING ALL CONTENT INCLUDED IN THE SAME), INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF SATISFACTORY QUALITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT. Fikty NOT REPRESENT OR WARRANT THAT (A) THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, (B) ANY DEFECTS OR ERRORS IN THE SERVICE WILL BE CORRECTED, OR (C) ANY CONTENT OR INFORMATION OBTAINED ON OR THROUGH THE SERVICE WILL EXACT.

Fikty ASSUMES NO RESPONSIBILITY FOR ANY CONTENT THAT YOU, OR OTHER THIRD PARTY USER published, sent or received THROUGH THE SERVICE. YOUR ACCESS TO ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS AT YOUR SOLE DISCRETION AND RISK.

Fikty WAIVER AND IS NOT LIABLE FOR ANY CONDUCT OR OTHERWISE YOURS USER INSIDE OR OUTSIDE THE SERVICE.

1. Thirdparty services.

The Service may contain advertisements and promotions offered by third parties and links to other web sites or resources. Fikty is not responsible for the availability (or unavailability) of such websites or external resources. If you decide to interact with third made available through our service, the terms of such party will govern your relationship with you. Fikty is not responsible for the words or actions of such third parties.

1. Limitation of Liability.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT BE LIABLE fikty, ITS AFFILIATES, EMPLOYEES, LICENSORS OR SERVICE PROVIDERS FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, PUNITIVE OR IMPROVED, INCLUDING WITHOUT LIMITATION, LOST PROFITS, WHAT HAS HAPPENED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE, (II) BEHAVIOR OR CONTENT OF OTHER USERS OR THIRD PARTIES THROUGH OR AFTER USE THE SERVICE; Or (iii) ACCESS TO OR ALTERATION UNAUTHORIZED USE OF YOUR CONTENT, EVEN IF fikty HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. WITHOUT PREJUDICE OF THE PREVIOUS, IN NO EVENT SHALL THE TOTAL LIABILITY fikty FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE WILL OVERCOME THE AMOUNT PAID, IF THAT ANY, BY YOU TO fikty DURING THE TWENTY-FOUR (24) MONTHS IMMEDIATELY BEFORE DATE ON WHICH PRESENTS A LAWSUIT, ARBITRATION OR OTHER PROCEEDING AGAINST fikty, WHETHER IN LAW OR EQUITY IN ANY COURT. LIMITATION OF DAMAGES DESCRIBED IN THE IMMEDIATELY PRECEDING SENTENCE APPLY: (i) REGARDLESS OF BUDGETS ON THE LIABILITY IS BASED (WHETHER IN DEFAULT UNDER CONTRACT, TORT, BY LEGAL PROVISIONS OR OTHERWISE), (ii ) REGARDLESS OF THE TYPE OF Defaults, and (iii) WITH RESPECT TO ALL EVENTS, THE SERVICE AND THIS AGREEMENT.

THE PROVISIONS OF THE LIMITATION OF LIABILITY SET FORTH IN SECTION 15 APPLY EVEN IF YOUR REMEDIES UNDER THIS AGREEMENT FAIL WITH RESPECT TO ITS ESSENTIAL PURPOSE.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO CAN SOME OR ALL OF THE EXCLUSIONS AND LIMITATIONS OF THIS SECTION MAY NOT APPLY TO YOU.

If you use fikty EXISTING AND IF YOU DO NOT AGREE TO BE BOUND BY THIS ARBITRATION AGREEMENT retroactively, you MUST unsubscribe from the retroactive application of this agreement to arbitration within the next 30 days, SPECIFIED AS FOLLOWS:
